Staff report

A. Conditional Use Permit: Application by Michael Allen of All Energy Solar, on behalf of Nokomis Hardware, for a conditional use permit to allow a canopy containing nine solar panels at 5155 34th Ave S, in the C1, Neighborhood Commercial district.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and return the conditional use permit for a solar energy system at 5155 34th Ave S. 

2. Yinghua Academy (BZZ-5785, Ward: 3), 1500 6th St NE (Kimberly Holien).

Staff report

A. Conditional Use Permit: Application by Craig Pederson of Grace Center for Community Life has for a conditional use permit to allow a K-12 school known as Yinghua Academy in an existing, non-residential building at 1500 6th St NE, in the R1A, Single-family district.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit for a K-12 school at 1500 6th St NE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. Approval of the final site, landscaping and dumpster enclosure plans by the Department of Community Planning and Economic Development – Planning Division.

  3. All site improvements shall be completed by October 15, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  4. The rock mulch proposed within the landscaped yards shall be replaced with turf grass.

  5. Perennials and shrubs that are a minimum of three feet in height and 60 percent opaque shall be provided along the south side of the southeast parking area, in compliance with Section 530.170 of the zoning code.

A. Conditional Use Permit: Application by Samantha Eubanks for a conditional use permit to allow a child care center in an existing, non-residential building at 1500 6th St NE, in the R1A, Single-family district.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit for a child care center at 1500 6th St NE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

Staff report

A. Conditional Use Permit: Application by David Graham, on behalf of Minnehaha United Methodist Church, for a conditional use permit to establish a preschool at 3701 50th St E in the R1A Single Family District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit to allow a preschool for the property located at 3701 50th St E, subject to the following conditions.

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. Department of Community Planning and Economic Development – Planning Division staff review and approval of the final site and landscape plans.

  3. Site improvements required by the zoning code or by the City Planning Commission shall be completed by October 15, 2014, or the permit may be revoked for non-compliance.

  4. The applicant shall secure 15 minute signage for the on street parking spaces along 37th Avenue South as the place for the required two (2) drop off parking spaces.

B. Variance: Application by David Graham, on behalf of Minnehaha United Methodist Church, for a variance to reduce the parking requirement from two (2) off street spaces and two (2) drop off spaces to zero (0) off street spaces and two (2) drop off spaces for the property located at 3701 50th St E in the R1A Single Family District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the parking requirement from two (2) off street spaces and two (2) drop off spaces to zero (0) off street spaces and two (2) drop off spaces for the property located at 3701 50th St E.

5. Seward Community Cafe Rezoning (BZZ-5786, Ward: 2), 2123-29 E Franklin Ave (Kimberly Holien).

Staff report

A. Rezoning: Application by Nils Collins of the Seward Community Cafe for a rezoning from the C1, Neighborhood Commercial district to the C2, Neighborhood Corridor Commercial district to allow for a sit down restaurant, including the serving of alcoholic beverages, with general entertainment at 2123-29 E Franklin Ave.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission and the City Council adopt the findings and approve the rezoning from the C1, Neighborhood Commercial district to the C2, Neighborhood Corridor Commercial district for the property located at 2123-29 Franklin Ave E.

B. Variance: Application by Nils Collins of the Seward Community Cafe for a variance to reduce the off-street parking requirement from 15 spaces to 14 spaces for property located at 2123-29 E Franklin Ave.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the minimum vehicle parking requirement from 15 spaces to 14 spaces for the property located at 2123-29 Franklin Ave E, subject to the following condition: 

  1. A minimum of seven bicycle parking spaces shall be provided at all times to qualify for the bicycle incentive in Section 541.220 of the zoning code.  

6. Church of St. Joan of Arc Gathering Space (BZZ-5705, Ward: 8), 4537 3rd Ave S (Janelle Widmeier).

A. Site Plan Review: Application by Michele Foster, on behalf of Church of St. Joan of Arc, for a site plan review application to allow a building addition for the property located at 4537 3rd Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review to allow a building addition for the property located at 4537 3rd Ave S, subject to the following conditions:

  1. The parking lot layout shall comply with the minimum parking space and aisle dimensions as required by section 541.330 of the zoning code.

  2. As required by section 530.170 of the zoning code, at least 6 canopy trees shall be planted on-site in the parking area in tree islands that are a minimum of 7 feet in width in any direction around a tree. Further, at least 85 percent of the parking spaces shall be located within 50 feet of a canopy tree.

  3. Community Planning and Economic Development Department – Planning Division staff review and approval of the final site, landscaping, building elevations, and floor plans.

  4. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by October 15, 2014, or the permit may be revoked for non-compliance.

7. 525 10th Ave SE (BZZ-5770, Ward: 3), 525 10th Ave SE (Janelle Widmeier).

A. Variance: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a variance to reduce the minimum front yard requirement adjacent to 6th St SE from 15 feet to 7 feet to allow the multiple-family dwelling with 10 units located at 525 10th Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission continue the variance to reduce the minimum front yard requirement adjacent to 6th St SE from 15 feet to 7 feet to allow the building located at the property located at 525 10th Ave SE to the October 29, 2012 meeting of the Planning Commission.

B. Variance: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a variance to increase the percentage of required parking spaces that may be satisfied by providing compact spaces from 25 to 100 percent for property located at 525 10th Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission continue the variance to increase the percentage of required parking spaces that may be satisfied by providing compact spaces from 25 to 100 percent located at the property located at 525 10th Ave SE to the October 29, 2012 meeting of the Planning Commission.

C. Site Plan Review: Application by Pat Mackey with Mackey Malin Architects, on behalf of CPM Development, for a site plan review for property located at 525 10th Ave SE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission continue the application for site plan review for a new multiple-family dwelling with 10 units located at the property located at 525 10th Ave SE to the October 29, 2012 meeting of the Planning Commission.

8. 501 15th Ave SE/1423 5th St SE (BZZ-5774, Ward: 3), 501 15th Ave SE/1423 5th St SE (Aly Pennucci).

A. Conditional Use Permit: Application by Scott Nelson, on behalf of Rusty Turpen, for a conditional use permit to increase the height from 4 stories (56 feet) to 5 stories (56 feet 8 inches) for a five story addition, with 16 new dwelling units, at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to increase the maximum building height from 4 stories (56 feet) to 5 stories (56 feet 8 inches) for the property located at 501 15th Ave SE/1423 5th St SE:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Variance: Application by Scott Nelson, on behalf of Rusty Turpen, for a variance to reduce the required side and rear yard setbacks from 13 feet to 5 feet for property located at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the required north interior side yard from 13 feet to 5 feet 10 inches and to reduce the required west interior side yard from 13 feet to 5 feet for the property located at 501 15th Ave SE/1423 5th St SE.

C. Variance: Application by Scott Nelson, on behalf of Rusty Turpen, for a variance to reduce the established front yard setback along 5th St S from 22 feet to 8 feet for property located at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the required front yard setback along 5th St SE from 15 feet to 8 feet for the property located at 501 15th Ave SE/1423 5th St SE.

D. Variance: Application by Scott Nelson, on behalf of Rusty Turpen, for a variance to reduce the minimum parking requirement from 59 spaces to 45 spaces for property located at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the minimum parking requirement from 59 spaces to 45 spaces for the property located at 501 15th Ave SE/1423 5th St SE.

E. Variance: Application by Scott Nelson, on behalf of Rusty Turpen, for a variance to increase the maximum lot coverage from 70 percent to 81 percent for property located at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum lot coverage from 70 percent to 81 percent for the property located at 501 15th Ave SE/1423 5th St SE.

F. Site Plan Review: Application by Scott Nelson, on behalf of Rusty Turpen, for a site plan review for property located at 501 15th Ave SE/1423 5th St SE, in the R5 Multiple Family Residence District and the UA University Area Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development– Planning Division recommends that the City Planning Commission approve the site plan review application for a five story addition, with 16 new dwelling units for the property located at 501 15th Ave SE/1423 5th St SE, subject to the following conditions:

  1. All site improvements shall be completed by October 15, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  2. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans before building permits may be issued.

  3. The width of the new walkway on the 5th St SE elevation shall not exceed 8 feet. The area between the building and 5th St SE that is not the walkway shall be landscaped and shall not include a patio.

  4. Landscaped areas not covered with turf grass, native grasses or other perennial flowering plants, vines, mulch, shrubs, trees or edible landscaping shall be covered would wood mulch or other similar materials. Rock mulch shall not be used.

  5. A minimum of 130 bicycle parking spaces shall be provided, 117 of which must meet long-term bicycle parking requirements.

  6. The existing buildings shall be repaired and renovated as needed so the existing building is compatible with the new addition. This shall include repairing or replacing existing porches, steps, entry doors, alcoves and windows, providing a fence in compliance with the zoning code along 15th Ave SE, repairing or rebuilding cornices and tuck pointing existing brick exteriors as noted on the elevations.

9. Birchwood Café Addition (BZZ-5773 and MS-227, Ward: 2), 3311 25th St E and 2505 33rd Ave S (Shanna Sether).

A. Rezoning: Application by Tracy Singleton for a petition to rezone 3311 25th St E and a portion of 2505 33rd Ave S from R1A Single-Family District to C1 Neighborhood Commercial District to allow for the expansion of an existing sit-down restaurant.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning petition to change the zoning classification for the property located at 3311 25th St E and a portion of 2505 33rd Ave S from R1A Single-Family District to C1 Neighborhood Commercial District to allow for the expansion of an existing sit-down restaurant.

B. Variance: Application by Tracy Singleton for a variance to reduce the required off-street parking from 9 spaces to 0 spaces, where 6 are grandfathered in. The expansion of the restaurant requires 3 additional parking spaces for the property located at 3311 25th St E and 2505 33rd Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the required off-street parking from 9 spaces to 6 spaces, where 6 are grandfathered in, to allow for the expansion of an existing sit-down restaurant located at 3311 25th St E in the C1 Neighborhood Commercial District, subject to the following conditions of approval:

  1. Bicycle racks shall be provided to accommodate no fewer than three (3) bicycles on the property and shall meet the minimum requirements for short term bicycle parking. The bicycle parking may be located in the public right-of-way with permission of the city engineer.

C. Variance: Application by Tracy Singleton for a variance to reduce the minimum lot area requirement for a single-family dwelling located at 2505 33rd Ave S from 5,000 square feet to 4,123 square feet for the property located at 3311 25th St E and 2505 33rd Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the minimum lot area requirement for a single-family dwelling located at 2505 33rd Ave S from 5,000 square feet to 4,123 square feet in the R1A Single-Family District.

D. Site Plan Review: Application by Tracy Singleton for a site plan review for the property located at 3311 25th St E and 2505 33rd Ave S.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the site plan review to allow for the expansion of an existing sit-down restaurant located at 3311 25th St E in the C1 Neighborhood Commercial District, subject to the following conditions:

  1. CPED planning staff review and approval of the final site plan, lighting plan and landscaping plan is required before permits may be issued. 

  2. All site improvements shall be completed by October 15, 2014, (unless extended by the Zoning Administrator) or permits may be revoked for noncompliance.

E. Minor Subdivision: Application by Tracy Singleton for a minor subdivision to adjust the common lot line between 3311 25th St E and 2505 33rd Ave S, including a subdivision variance to allow for a residential parcel with more than 5 sides.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the minor subdivision to adjust the common lot line between 3311 25th St E and 2505 33rd Ave S, including a subdivision variance to allow for a residential parcel with more than 5 sides.
