1.   Land Sale – 2945 Bryant Ave N (Staff: Jim Voll)

Review for consistency with the Comprehensive Plan the sale of 2945 Bryant Ave N for the development of a single-family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

2.   Land Sale – 4114 Fremont Ave N (Staff: Jim Voll) 

Review for consistency with the Comprehensive Plan the sale of 4114 Fremont Ave N for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

3.   Land Sale – 3239 Lyndale Ave N (Staff: Jim Voll) 

Review for consistency with the Comprehensive Plan the sale of 3239 Lyndale Ave N for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

4.   Land Sale – 3326 Lyndale Ave N (Staff: Jim Voll) 

Review for consistency with the Comprehensive Plan the sale of 3326 Lyndale Ave N for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

5.   Land Sale – 3334 Lyndale Ave N (Staff: Jim Voll) 

Review for consistency with the Comprehensive Plan the sale of 3334 Lyndale Ave N for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

6.   Land Sale – 3407 Lyndale Ave N (Staff: Jim Voll) 

Review for consistency with the Comprehensive Plan the sale of 3407 Lyndale Ave N for the development of a single family home.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

The City Planning Commission approved the staff recommendations for the above consent items.

Public Hearing

1. Urban Arts Academy (BZZ-5754, Ward: 8), 3901 Chicago Ave and 3900 Elliot Ave S (Janelle Widmeier).

A. Conditional Use Permit: Application by Lisa Lindstrom, on behalf of Urban Arts Academy, for a conditional use permit to allow a preschool for the property located at 3900 Chicago Ave S and 3901 Elliot Ave S.

Action: The City Planning Commission adopted the findings and approved the application for a conditional use permit to allow a preschool located at the property of 3901 Chicago Ave and 3900 Elliot Ave, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

  2. Perennials and/or native grasses shall be planted in the yard between the parking lot and E 39th St to provide screening as required by section 541.360 of the zoning code.

  3. Department of Community Planning and Economic Development – Planning Division staff review and approval of the final site and landscape plans.

  4. Site improvements required by the zoning code or by the City Planning Commission shall be completed by October 1, 2014, or the permit may be revoked for non-compliance.

2. Howe Elementary School Renovation (BZZ-5761, Ward: 12), 3733 43rd Ave S (Aly Pennucci).

A. Conditional Use Permit: Application by Paul G. May, on behalf of Minneapolis Public Schools, for a conditional use permit to reestablish a school in the R1A Single Family District located at 3733 43rd Ave S.

Action: The City Planning Commission adopted the findings and approved the conditional use permit for a school, grades K-12, at 3733 43rd Ave S in the R1A Single Family Residence District, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. The applicant shall provide a minimum of forty-five (45) bicycle parking spaces on site or within the public right-of-way, as approved by the city engineer.

  3. All site improvements shall be completed by October 1, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  4. Fences located in a required yard shall not exceed three (3) feet in height. The fence height may be increased by one (1) foot if constructed of open, decorative, ornamental fencing materials that are less than sixty (60) percent opaque. If chain link fencing is used it shall be vinyl-coated chain link.

Approved on consent 7-0.

B. Variance: Application by Paul G. May, on behalf of Minneapolis Public Schools, for a variance to reduce the required front yard from 20 feet to 0 feet to reestablish an accessory play area with recreational play equipment located at 3733 43rd Ave S.

Action: The variance to reduce the required front yard from 20 feet to 0 feet to reestablish an accessory play area with recreational play equipment, at 3733 43rd Ave S in the R1A Single Family Residence District was withdrawn.

Approved on consent 7-0.

3. 3013 36th Ave S (BZZ-5762, Ward: 9), 3013 36th Ave S (Aly Pennucci).

A. Rezoning: Application by Karen Linner to rezone the property located at 3013 36th Ave S from the R1A Single Family District to the C1 Neighborhood Commercial District.

Action: The City Planning Commission recommended that the City Council adopt the findings and approve the application for the rezoning of 3013 36th Ave S from the R1A Single Family Residence District to the C1 Neighborhood Commercial District.

Approved on consent 7-0.

4. 4250 Upton (BZZ-5745, Ward: 13), 4250 and 4264 Upton Ave S (Hilary Dvorak).

A. Variance: Application by Carol Lansing with Faegre Baker Daniels, LLP., on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for setback variances along the north and west property lines for decks/balconies that do not meet the dimensional requirements for permitted obstructions of the zoning code for the properties located at 4250 and 4264 Upton Ave S.

Action: The City Planning Commission adopted the findings and approved the variance to reduce the north interior side yard setback from 9 feet to 3 feet for three rooftop terraces and to 6 feet for two balconies with awnings and to reduce the west interior property line from 10 feet to 7 feet for two balconies with awnings and from 9 feet to 5 feet for two rooftop terraces and to 6 feet for two balconies with awnings for the property located at 4250 and 4264 Upton Ave S.

Approved on consent 7-0.

B. Site Plan Review: Application by Carol Lansing with Faegre Baker Daniels, LLP., on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a site plan review for a mixed-use building including 6,052 square feet of commercial space and 18 dwelling units for the properties located at 4250 and 4264 Upton Ave S.

Action: The City Planning Commission adopted the findings and approved the site plan review application for the property located at 4250 and 4264 Upton Ave S subject to the following conditions:

  1. Approval of the final site, elevation, landscaping and lighting plans by the Department of Community Planning and Economic Development – Planning Division.

  2. All site improvements shall be completed by October 1, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. Landscape materials that reach a minimum height of five feet shall be used to screen the transformer from the public sidewalk along Upton Avenue South.

  4. The area between the columns on the northern portion of the first floor west building wall shall be reduced to a length that is less than 25 feet.

Approved on consent 7-0.

5. MN SNAP (BZZ-5766, Ward: 3), 2822 Washington Ave N (Kimberly Holien).

A. Rezoning: Application by Dana Andresen of the Minnesota Spay and Neuter Assistance Program (MN SNAP) has applied for a rezoning from the I2, Medium Industrial district to the C1, Neighborhood Commercial district to allow for a veterinary clinic at 2822 Washington Ave N.

Action: Notwithstanding staff recommendation, the City Planning Commission recommended that the City Council approve the application for rezoning from I2, Medium Industrial District to the C1, Neighborhood Commercial district for the property located at 2822 Washington Ave N, based on the following findings:

  1.  Unique use that does not meet the standard definition of veterinary clinic in the zoning code. 

  2. The use is in the public interest and is not solely for the interest of a single property owner.

  3. The proposed C1 zoning is compatible with other zoning classifications within the general area.

  4. Supports Land Use Policy 1.1: Establish land use regulations to achieve the highest possible development standards, enhance the environment, protect public health, support a vital mix of land uses, and promote flexible approaches to carry out the comprehensive plan.

Aye: Cohen, Huynh, Kronzer, Luepke-Pier, Mammen, Schiff and Wielinski.

The motion carried 7-0.

The next Committee of the Whole meeting is October 4, 2012.
