Staff report

A. Registered Land Survey: Application by Paul Thorp of Hansen Thorp Pellinen Olson, Inc, on behalf of Metro Transit, h for a Registered Land Survey (RLS), for an existing parking ramp located at 400 3rd St S located in B4-1 Downtown Business District, and DP Downtown Parking Overlay District. The purpose of this RLS is to create different ownership tracts for the ground level transit related facilities.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission approve the preliminary and final Registered Land Survey application for property located at 400 3rd St S, subject to the following conditions:

  1. This RLS creates certain tracts (namely, Tracts A, B, C, D and F) that, if separately redeveloped, would not meet the requirement of the zoning and subdivision ordinances that prohibits lots with more than five sides. Approval of this RLS does not constitute approval for the separate redevelopment of any tract if such tract does not comply with applicable zoning and subdivision ordinances.

  2. This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County.

2. Aurora Charter School—Elementary Addition (BZZ-5727, Ward: 2 and 9), 2101 26th St E (Janelle Widmeier).

Staff report

A. Nonconforming Use Expansion: Application by Jim Dowds, on behalf of Aurora Charter School, for an expansion of a nonconforming use to allow additional classrooms/floor area to be added to a grade school located in the I1 Light Industrial District for the property located at 2101 26th St E.

Recommended Motion: The Department of Community Planning and Economic Development—Planning Division recommends that the City Planning Commission adopt the findings and approve the application for an expansion of a legal nonconforming use to allow additional classrooms/floor area to be added to a grade school located in the I1 Light Industrial District for the property located at 2101 26th St E, subject to the following condition:

  1. At least 45 bicycle parking spaces shall be provided as required by section 541.180 of the zoning code.

3. Light House Academy of Nations (BZZ-5732, Ward: 2), 2600 26th Ave S (Janelle Widmeier).

A. Conditional Use Permit: Application by Michael Allen, on behalf of Bellwether Media, for a conditional use permit to install a Solar Energy System on the property located at 5357 Penn Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit to allow installation of a solar energy system for the property located at 5357 Penn Ave S, subject to the following conditions.

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. The solar energy system shall comply with all required setbacks.

  3. The solar energy system shall not reflect sunlight on to adjacent properties.

5. U of M Market (BZZ-5663, Ward: 2), 614 Washington Ave SE (Aly Pennucci).

Staff report

A. Rezoning: Application by Ahmed Mohamed to rezone the property located at 614 Washington Ave SE from the C1 Neighborhood Commercial District to the C2 Neighborhood Corridor Commercial District to allow tobacco sales accessory to the existing grocery store.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission and City Council adopt the findings and approve the application for the rezoning of 614 Washington Ave SE from the C1 Neighborhood Commercial District, PO Pedestrian Oriented Overlay District, UA University Area Overlay District, and MR Mississippi River Critical Area Overlay District to the C2 Neighborhood Corridor Commercial District, PO Pedestrian Oriented Overlay District, UA University Area Overlay District, and MR Mississippi River Critical Area Overlay District.

6. River of Life Lutheran Church Overnight Shelter (BZZ-5654, Ward: 5), 1110 22nd Ave N/2200 Fremont Ave N (Aly Pennucci). This item was continued from the August 13, 2012 meeting.

Staff report

A. Conditional Use Permit: Application by Allysen Hoberg of St. Stephens Human Services, on behalf of River of Life Lutheran Church, for a conditional use permit to allow an overnight shelter accessory to an existing place of assembly located at 1110 22nd Ave N / 2200 Fremont Ave N.

Recommended Motion: The Department of Community Planning and Economic Development - Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit application to allow an overnight shelter accessory to a religious institution place of assembly located at 1110 22nd Avenue N / 2200 Fremont Avenue N., subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. The use shall comply with the standards for overnight shelters required by section 537.110 of the zoning code. 

  3. The required management plan shall be updated yearly and copies shall be provided to adjacent property owners and to The Department of Community Planning and Economic Development - Planning Division. At minimum, the management plan shall include the following:

a)     A security plan that includes the hours of operation, the hours guests can arrive, details on shelter security and police monitoring, and a security plan that addresses lighting, cameras and littering in the alley.

b)    A communication plan that includes details on who to call with concerns, documentation of issues that arise, and monthly meetings to discuss shelter operations.

c)     A building and grounds plan that includes frequency for trash and recycling pick-up and lighting in the alley.

  1. The shelter shall not use or participate in the lottery system for placing guests at this shelter.

  2. The winter shelter shall operate yearly from November 1st through May 15th.

  3. The applicant shall add additional trash and recycling pick-ups (a minimum of two times per week) during shelter operations.

  4. The applicant shall work with the City’s Crime Prevention Specialist assigned to the 4th Precinct to develop a specific security plan for the subject site. This shall include, at minimum, adding additional lighting and surveillance cameras in the alley monitored by shelter staff or an equivalent proposal. All lighting shall be required to comply with section 535.590 of the Zoning Code.

  5. All waste receptacles shall be fully enclosed and screened unless determined to be a safety concern by the City’s Crime Prevention Specialist. A detail of the trash enclosure shall be submitted that complies with Section 535.80 of the Zoning Code.

  6. When going outdoors for air or smoking breaks, shelter staff and guests shall remain to the front of the church along 22nd Avenue North and shall not assemble in the alley or to the side of the church. 

  7. No personal belongings shall be stored outside of the building. Guests shall be provided space to store any personal belongings within the shelter space.

7. E&L Supermarket and Deli  (BZZ-5743, Ward: 4), 1122 Lowry Ave N (Kimberly Holien).

Site plan

A. Site Plan Review: Application by Scott Nelson of DJR Architecture, on behalf of Adil Albosaad, for a site plan review for a 4,000 square foot addition to an existing building at 1122 Lowry Ave N in the C1 Neighborhood Commercial district. The addition will include a grocery store and delicatessen on the first floor and three dwelling units on the second floor. 

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the site plan review for a 4,213 square foot building addition including commercial space and three dwelling units at 1122 Lowry Ave N, subject to the following conditions:

  1. CPED Planning staff review and approval of the final site, elevation, floor and landscaping plans.

  2. All site improvements shall be completed by September 19, 2014, unless extended by the Zoning Administrator, or the approvals may be revoked for noncompliance.

  3. Shelving, coolers, mechanical equipment or other similar fixtures shall not block views into and out of the building in the area between four (4) and seven (7) feet above the adjacent grade.   

  4. The north building wall shall be painted uniformly to match the addition. 

  5. One additional canopy tree shall be provided within the landscaped yard on the west side of the site, in accordance with Section 530.160 of the zoning code.

  6. A landscaped yard a minimum of seven feet in width shall be provided between the parking area and the alley, in accordance with Section 530.170 of the zoning code. Said landscaped area shall include screening that is a minimum of three feet in height and 60 percent opaque. 

  7. Turf grass or wood mulch shall be provided within the landscaped area in the northwest corner of the site to achieve proper maintenance of the landscaped area, in accordance with Section 530.210 of the zoning code.

  8. The asphalt in the parking lot and driveways shall be repaired and/or replaced as necessary in accordance with Section 541.300 of the zoning code. 

  9. The parking lot shall be striped in accordance with Section 541.320 of the zoning code.

  10. A minimum of three bicycle parking spaces shall be provided that meet the standards for short-term bicycle parking, per Section 541.180 of the zoning code. 

  11. The refuse storage container shall be repaired or replaced as necessary in accordance with Section 535.80 of the zoning code.

8. Blaine Auto Repair (BZZ-5722, Ward: 1), 3001 Central Ave NE (Joe Bernard).

A. Conditional Use Permit: Application by Marty Shirber for a conditional use permit for a minor automobile repair facility in the C2 Neighborhood Corridor Commercial District for the property located at 3001 Central Ave NE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit to allow a minor automobile repair use for the property located at 3001 Central Ave NE, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

B. Site Plan Review: Application by Marty Shirber for a site plan review for the property located at 3001 Central Ave NE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review located at the property of 3001 Central Ave NE, subject to the following conditions:

  1. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site, lighting and landscape plans.

  2. All site improvements shall be completed by September 19, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. An area for landscaping at least 7 feet in width shall be provided along the east property line. In addition, screening not less than six feet in height and not less than 95 percent opaque shall be provided along the alley.

  4. A decorative wrought iron fence shall be provided along the west and south property lines where adjacent to parking and loading areas.

  5. A third canopy tree shall be added along the south property line adjacent to proposed parking.

  6. Refuse storage containers shall be properly screened as required by Section 535.80 of the zoning code.

  7. All service bay doors shall be painted a consistent color.

9. Minneapolis Urban League Lot Division (BZZ-5735 and MS-226, Ward: 5), 2000 Plymouth Ave N (Shanna Sether).

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Minor Subdivision: Application by Daniel Ostroot of Clark Engineering Corporation, on behalf of the Minneapolis Urban League, for a minor subdivision that would create two lots at 2000 Plymouth Ave N. One lot would be for the principal parking facility for the Minneapolis Urban League and one lot would be for the office building and accessory parking lot.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the minor subdivision that would create two lots at 2000 Plymouth Ave N. Parcel A would be for the office building and accessory parking lot and Parcel B would be for the principal parking facility for the Minneapolis Urban League.

10. Burch Building Parking Lot (BZZ-5715, Ward: 7), 1925 Colfax Ave S (Shanna Sether).

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. B. Conditional Use Permit: Application by Merrie Sjogren of Burch Investors, LLC, for a conditional use permit to allow for a principal parking facility to allow for a principal parking facility located at 1925 Colfax Ave S in the C1 Neighborhood Commercial District.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the minimum lot area requirement from 5,000 square feet to approximately 4,450 square feet (11%) to allow for a principal parking facility located at 1925 Colfax Ave S in the C1 Neighborhood Commercial District.

C. Site Plan Review: Application by Merrie Sjogren of Burch Investors, LLC, for a site plan review for property located at 1925 Colfax Ave S in the C1 Neighborhood Commercial District.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the site plan review to allow for a principal parking facility located at 1925 Colfax Ave S in the C1 Neighborhood Commercial District, subject to the following conditions:

  1. CPED planning staff review and approval of the final site plan, lighting plan and landscaping plan is required before permits may be issued. 

  2. All site improvements shall be completed by September, 19, 2014, (unless extended by the Zoning Administrator) or permits may be revoked for noncompliance.

  3. The existing chain link fence located along the south property line shall be removed and as an alternative compliance measure a four foot high decorative metal fence be installed in its place.

11. Star Addition (BZZ-5747 and PL-269, Ward: 7), 901 2nd St N (Janelle Widmeier).

A. Variance: Application by Dan Pellinen with Tushie Montgomery Architects, on behalf of Star Tribune Media Company, LLC, for a variance to reduce the minimum lot width requirement for the parking facility on proposed Lot 1 located at 901 2nd St N from 40 feet to 28 feet, which is a 30 percent reduction.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the minimum lot width requirement for the parking facility on proposed Lot 1 by 30 percent from 40 feet to 28 feet for the property located at 901 2nd St N.

B. Plat: Application by Dan Pellinen with Tushie Montgomery Architects, on behalf of Star Tribune Media Company, LLC, for a plat subdivision, including subdivision variances to allow lots for multiple-family dwellings with more than 5 sides and no utility easements for lots without alley access for the property located at 901 2nd St N.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a preliminary and final plat, including subdivision variances to allow lots for multiple-family dwellings with more than 5 sides and no utility easements for lots without alley access, for the property located at 901 2nd St N.

12. 815 2nd Street Apartments (BZZ-5726, Ward: 7), 901 2nd St N (Janelle Widmeier).

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review for a multiple-family dwelling with 137 units for the property located at 901 2nd St N, subject to the following conditions:

  1. Department of Community Planning and Economic Development – Planning Division staff review and approval of the final building elevations, floor, site and landscape plans.

  2. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by September 19, 2014, or the permit may be revoked for non-compliance.

  3. Mechanical equipment shall be screened as required by section 535.70 of the zoning code.
