Staff report

38th Street Station Area Rezoning Study, East of Hiawatha

A. Map Amendment: Amending the Minneapolis Code of Ordinances, Chapter 521, Zoning Districts and Maps Generally, affecting the primary and overlay zoning districts contained in Plates 27, 33, and 34.

The purpose of the amendments is to consider rezoning of property within the portion of the 38th Street Station Area Plan study area that is east of Hiawatha Avenue. The proposed rezoning affects primary and overlay zoning districts.

Recommended Motion:  The Department of Community Planning and Economic Development - Planning Division recommends that the City Planning Commission and City Council find that obtaining consent signatures for the rezoning of properties from residential to commercial in the 38th Street LRT Station Area Rezoning Study Area would be impractical and further recommends that the City Planning Commission and City Council adopt the above findings and approve the zoning map amendment for the rezoning of parcels in the attached exhibits.

2. 3620 E 26th St and 2548 37th Ave S (MS-221, Ward: 2), 3620 E 26th St and 2548 37th Ave S (Becca Farrar).

A. Minor Subdivision: Application by Paramount Real Estate Corporation, on behalf of Cityview Church, for a minor subdivision application for the properties located at 3620 E 26th St and 2548 37th Ave S. The purpose of this subdivision is to create one lot for the church and one lot for the parsonage/house. No new development is proposed.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission approve the minor subdivision for the properties located at 3620 E 26th St and 2548 37th Ave S.

3. 2101-2107 Lowry Avenue NE(BZZ-5546 and MS-220, Ward: 1), 2101-2107 Lowry Ave NE (Aly Pennucci).

Staff report

A. Variance: Application by Sarah Larson for a variance to reduce the minimum lot area requirement for an existing duplex located at 2101-03 Lowry Ave NE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the minimum lot area from 5,000 square feet to 4,602 square feet to allow for the proposed west lot (Parcel A) at 2101-2107 Lowry Ave NE in the R1A Single-Family District.

B. Minor Subdivision: Application by Sarah Larson for a minor subdivision to adjust the lot line between the properties of 2101-2107 Lowry Ave NE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the minor subdivision to adjust the lot line between the properties of 2101-2107 Lowry Ave NE for two existing two-family dwellings, subject to the following condition:

  1. An easement shall be recorded with Hennepin County granting Parcel A access to and use of two (2) off-street parking spaces on Parcel B. Documentation of said recording shall be provided to CPED-Planning staff.

4. Minneapolis Public Schools (MPS) Education Service Center (BZZ-5553, Ward: 5), 1250 West Broadway (Becca Farrar).

A. Conditional Use Permit: Application by UrbanWorks Architecture, on behalf of Minneapolis Public Schools (MPS), to amend the conditional use permit for a Planned Unit Development for review of a master sign plan for the new MPS Headquarters building on the property located at 1250 West Broadway.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application to amend the previously approved conditional use permit application for the MPS Education Service Center Planned Unit Development to include a master sign plan on the property located at 1250 West Broadway Ave subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. As previously required (BZZ-4962 and BZZ-5102) by Section 527.120 of the Zoning Code, the development shall include the following amenities from Table 527-1, Amenities: Leadership in Energy and Environmental Design (LEED) NC Silver Certification, Art Feature, Shared Bicycles, Reflective Roof, Shared Vehicle, Decorative fencing, Enhanced Stormwater Management, and a Recycling Storage Area.

  3. As required for the master sign plan by Section 527.120 of the Zoning Code, the development shall include the following amenity from Table 527-1: LEED NC Gold Certification.

  4. All new signs shall relate in size, shape, material, color, illumination and character to the function and architectural character of the building.

  5. A total of five wall-mounted signs shall be permitted on the premises. Three of the five signs shall be permitted to exceed the maximum permitted height as outlined in the staff report.

  6. Backlit signs are prohibited.

5. Anytime Fitness (BZZ-5552, Ward: 5), 2104 and 2110 West Broadway (Becca Farrar).

A. Rezoning: Application by Tara Watson, on behalf of Selene Properties, Inc., for a petition to rezone the subject properties from the C1 (Neighborhood Commercial) district to the C2 (Neighborhood Corridor Commercial) district to allow a major sports and health facility within the existing building located at 2104 & 2110 West Broadway.

Recommended Motion: The Department of Community Planning and Economic Development - Planning Division recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning petition to change the zoning classification of the properties located at 2104 & 2110 West Broadway from the C1 district to the C2 district.

B. Conditional Use Permit: Application by Tara Watson, on behalf of Selene Properties, Inc., for a conditional use permit for a major sports and health facility located at 2104 & 2110 West Broadway.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a major sports and health facility within the existing building on the properties located at 2104 & 2110 West Broadway subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.   

  2. Windows in the proposed major sports and health facility shall be unobstructed in order to allow views into and out of the building along West Broadway.

  3. Bicycle parking shall be provided that meets the requirements as outlined in Section 541.220 of the Zoning Code.

  4. The property shall be in full compliance with the approved site plan per BZZ-1158 and BZZ-1712.

6. 1101 University (BZZ-5523, Ward: 3), 1101 University Ave SE (Janelle Widmeier). This item was continued from the May 7, 2012 meeting.

A. Conditional Use Permit: Application by Jim LaValle with Doran Development LLC for a conditional use permit to increase the maximum height from 4 to 5 stories and from 56 to 61.2 feet for the property located at 1101 University Ave SE to allow a new multiple-family dwelling with 95 units.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and deny the application for a conditional use permit to increase the maximum height from 4 to 5 stories for the property located at 1101 University Ave SE.

B. Variance: Application by Jim LaValle with Doran Development LLC for a variance to increase the maximum FAR from 2.4 to 3.08 for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to increase the maximum floor area ratio from 2.4 to 2.9 at the property of 1101 University Ave SE

C. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the minimum lot area requirement by 23.2 percent for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to reduce the minimum lot area requirement by 23.2 percent located at the property located at 1101 University Ave SE.

D. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the front yard requirement adjacent to University Avenue from the established setback of 27 feet to 15 feet to allow the building and a landing exceeding 36 square feet in area and to 0 feet to allow a plaza/walkway and stairs that exceed 6 feet in width and bicycle parking and to allow awnings to extend more than 2.5 feet into the required yard for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to reduce the front yard requirement adjacent to University Ave from the established setback of 29.5 feet to 15 feet to allow the building and a landing exceeding 36 square feet in area and to 0 feet to allow a plaza/walkway and stairs that exceed 6 feet in width at the property of 1101 University Ave SE.

E. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the corner side yard requirement adjacent to 11th Ave from 15 feet to 5.3 feet to allow the building and a landing exceeding 36 square feet in area and to allow awnings to extend more than 2.5 feet into the required yard for the property located at 1101 University Ave SE.

Recommended Motion: The variance application to reduce the corner side yard requirement adjacent to 11th Ave from 15 feet to 5.3 feet to allow the building and a landing exceeding 36 square feet in area and to allow awnings to extend more than 2.5 feet into the required yard at the property of 1101 University Ave SE has been withdrawn.

F. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the rear yard requirement (adjacent to the north lot line) from 5 feet to 2 feet to allow a generator and transformer and pads for each for the property located at 1101 University Ave SE.

Recommended Motion: The variance application to reduce the rear yard requirement has been withdrawn.

G. Site Plan Review: Application by Jim LaValle with Doran Development LLC for a site plan review for a multiple-family dwelling with 95 units located at 1101 University Ave SE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and deny the application for site plan review to allow a multiple-family dwelling with 95 units for the property located at 1101 University Ave SE.

7. Trader Joe’s (BZZ-5555, Ward: 10), 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S (Becca Farrar).

Recommended Motion: The Department of Community Planning and Economic Development - Planning Division recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning petition to change the zoning classification of the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S from the C1 district to the C2 district.

B. Conditional Use Permit: Application by TOLD Development Company, on behalf of Geurts Family, LLC, Pochade II, LLC, and Trader Joe’s, for a conditional use permit for an off-sale liquor store for the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a 1,200 square foot off-sale liquor store within the proposed grocery store on the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.   

  2. Windows in the off-sale liquor store shall be unobstructed in order to allow views into and out of the building along Lyndale Ave S and W27th St.

C. Variance: Application by TOLD Development Company, on behalf of Geurts Family, LLC, Pochade II, LLC, and Trader Joe’s, for a variance of the reverse corner setback requirement along the north property line adjacent to W 27th St for the first 40 feet from west to east for the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance of the reverse corner setback requirement along the north property line adjacent to W 27th St for the first 40 feet from west to east from 13 feet, 6 inches to 0 feet on the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

D. Variance: Application by TOLD Development Company, on behalf of Geurts Family, LLC, Pochade II, LLC, and Trader Joe’s, for a variance of the loading requirement for the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance of the off-street loading requirement for the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

E. Site Plan Review: Application by TOLD Development Company, on behalf of Geurts Family, LLC, Pochade II, LLC, and Trader Joe’s, for a site plan review for a new single-story, 14,299 square foot grocery store that includes a 1,200 square foot beer/wine store located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S.

Recommended Motion: The Department of Community Planning and Economic Development– Planning Division recommends that the City Planning Commission approve the site plan review application for a new single-story, 14,299 square foot grocery store that includes a 1,200 square foot beer/wine store on the properties located at 2700, 2708, 2712, 2716 and 2720/2724 Lyndale Ave S subject to the following conditions:

  1. Planning Staff review and approval of the final site, elevation, lighting and landscaping plans before building permits may be issued.

  2. All site improvements shall be completed by May 21, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. A final merchandising plan for the building shall be provided for review and approval. No shelving, signage, merchandise, newspaper racks or other mechanisms shall be placed in front of the required ground level transparent windows.

  4. The Travel Demand Management Plan must be approved by the Planning Director prior to submission of plans for final approval and building permit issuance. 

  5. A detail of the privacy fence shall be provided in the final submittal. No board on board cedar fencing shall be permitted. The extent of the fencing shall be clearly delineated on the site plan in order to verify that it does not affect sight lines.

  6. A detail of the trash enclosure shall be submitted that complies with Section 535.80 of the Zoning Code.

  7. A living wall system shall be incorporated into the west elevation of the building as shown in order to break up the blank uninterrupted walls greater than 25 feet.
