Staff report

A. Minor Subdivision: Application by Russ Barclay of Urban Homeworks for a minor subdivision to adjust the common lot line between 2608 and 2616 Blaisdell Ave.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the minor subdivision application for properties located at 2608 and 2616 Blaisdell Ave.

B. Variance: Application by Russ Barclay of Urban Homeworks for a variance to reduce the north interior side yard setback from 7 feet to 5 feet for the existing multiple-family dwelling at 2616 Blaisdell Ave.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the north interior side yard setback from 7 feet to 5 feet to allow the building for the property located at 2616 Blaisdell Ave.

C. Variance: Application by Russ Barclay of Urban Homeworks for a variance to reduce the south interior side yard setback from 5 feet to 0 feet for existing surface parking, a patio, play equipment and a pergola at 2608 Blaisdell Ave.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the variance to reduce the south interior side yard setback from 5 feet to 0 feet to allow the existing southernmost row of parking, a patio, a playground and a pergola for the property located at 2608 Blaisdell Ave.

2. 731 Hennepin Ave (BZZ-5539, Ward: 7), 731 Hennepin Ave (Becca Farrar).

Site plan

A. Site Plan Review: Application by Shea, Inc., on behalf of Zel-Wel, LLC, for a site plan review application in order to allow roof top additions on an existing two-story structure located at 731 Hennepin Ave totaling approximately 2,780 square feet. The property is zoned B4-2 (Downtown Business) District and is located in the DP (Downtown Parking) Overlay District.

Recommended Motion: The Department of Community Planning and Economic Development– Planning Division recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow roof top additions totaling 2,780 square feet on an existing two-story structure located at 731 Hennepin Ave subject to the following conditions:

  1. Planning Staff review and approval of the final site, floor plans and elevations. 

  2. All site improvements shall be completed by May 7, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  3. All ground level windows must be transparent (non-reflective) as required by Section 530.120 of the Zoning Code.

  4. The proposed 3rd floor roof-top addition that is permanent shall include windows that meet the 10% window requirement along 8th Street as required by Section 530.120 of the Zoning Code.

  5. Incorporation of windows, entries, recesses, projections or other architectural elements on the proposed 3rd floor roof-top addition located along the south and east elevations of the building in order to break up the blank uninterrupted wall that exceeds 25 feet in width per Section 530.120 of the Zoning Code.

  6. The exterior of all permanent roof-top additions shall be composed of metal siding.

  7. A minimum of 4 bicycle parking spaces shall be provided that meet the standards as outlined in Chapter 541.180 of the Zoning Code.

  8. All roof-top mechanical equipment shall be screened as outlined in Section 535.70 of the Zoning Code.

3. Roosevelt Branch Library (BZZ-5528, Ward: 12), 4026 28th Ave S (Janelle Widmeier).

Staff report

A. Conditional Use Permit: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a conditional use permit to allow a 600 sq. ft. addition to a library located in the R1A district at 4026 28th Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a 600 square foot addition to a library located in the R1A district at the property of 4026 28th Ave S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. Community Planning and Economic Development Department – Planning Division staff review and approval of the final elevations, floor, site and landscape plans.

  3. Site improvements required by the zoning code or by the City Planning Commission shall be completed by May 7, 2013, or the permit may be revoked for non-compliance.

B. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to reduce the established front yard requirement of 29 feet to allow a landing exceeding 36 sq. ft., stairs exceeding 6 ft. in width, patios exceeding 50 sq. ft. and extending more than 4 ft. into the yard, benches, and bicycle parking for property located at 4026 28th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the established front yard requirement of 29 feet to allow a landing exceeding 36 square feet, stairs exceeding 6 feet in width, patios exceeding 50 square feet and extending more than 4 feet into the yard, benches, and bicycle parking for the property located at 4026 28th Ave S.

C. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to reduce the north side yard requirement from 5 ft. to 3 ft. to allow a refuse storage area for property located at 4026 28th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the north side yard requirement from 5 feet to 3 feet to allow a refuse storage area for the property located at 4026 28th Ave S. 

D. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to reduce the rear yard requirement to allow a parking area (drive aisle) and to vary the landscaping and screening requirements for property located at 4026 28th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the rear yard requirement to allow a parking area (drive aisle) and to vary the landscaping and screening requirements for the property located at 4026 28th Ave S. 

E. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to reduce the minimum drive aisle width from 22 ft. to 14 ft for property located at 4026 28th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the minimum drive aisle width from 22 feet to 14 feet for the property located at 4026 28th Ave S.

F. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to increase the maximum height of a fence located in a required front yard from 4 ft. to 5.2 ft for property located at 4026 28th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum height of a fence located in a required front yard from 4 feet to 5.2 feet for the property located at 4026 28th Ave S.

G. Variance: Application by Jerry Hagen with Hagen Christensen and McIlwain Architects, on behalf of the Hennepin County Property Services Department—Design and Construction Division, for a variance to increase the maximum height of a fence in a required side yard from 6 ft. to 8 ft. to allow a refuse storage enclosure for property located at 4026 28th Ave S.

Recommended Motion: The variance to increase the maximum height of a fence in a required side yard from 6 feet to 8 feet to allow a refuse storage enclosure has been withdrawn.

4. Mulroy’s Body Shop(BZZ-5483, Ward: 8), 3900 and 3920 Nicollet Ave (Tom Leighton).

A. Rezoning: Application by R401K LLC for a rezoning of 3900 and 3920 Nicollet Ave from R2B to C2 in order to rehabilitate the office portion of the existing building at 3920 Nicollet Ave to improve the offices of the auto body business, and to house several commercial businesses that would be accessed through a separate entrance off Nicollet Ave, which would meet the Zoning Code definition of a “shopping center.”

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission and the City Council adopt the findings and deny the rezoning from the R2B, Two-family Residential District to the C2, Neighborhood Corridor Commercial District for the properties located at 3900 and 3920 Nicollet Ave S.

B. Conditional Use Permit: Application by R401K LLC for a conditional use permit to establish a shopping center in the C2 zoning district for properties located at 3900 and 3920 Nicollet Ave.

Recommended Motion: The Department of Community Planning and Economic Development - Planning Division recommends that the City Planning Commission adopt the findings and deny the conditional use permit for a shopping center in the C2 zoning district for the properties located at 3900 and 3920 Nicollet Ave S.

C. Variance: Application by R401K LLC for a variance of the allowed sign location to permit up to 60 square feet of the total signage area to be located on the north wall of the building (enumerated variance #21)for properties located at 3900 and 3920 Nicollet Ave.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the application for a variance to allow up to 60 square feet of the total signage area to be located on the north wall of the building for the properties located at 3900 and 3920 Nicollet Ave S.

5. 1101 University (BZZ-5523, Ward: 3), 1101 University Ave SE (Janelle Widmeier).

A. Conditional Use Permit: Application by Jim LaValle with Doran Development LLC for a conditional use permit to increase the maximum height from 4 to 5 stories and from 56 to 61.2 feet for the property located at 1101 University Ave SE to allow a new multiple-family dwelling with 95 units.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and deny the application for a conditional use permit to increase the maximum height from 4 to 5 stories and from 56 to 61.2 feet for the property located at 1101 University Ave SE.

B. Variance: Application by Jim LaValle with Doran Development LLC for a variance to increase the maximum FAR from 2.4 to 3.08 for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to increase the maximum floor area ratio from 2.4 to 3.08 at the property of 1101 University Ave SE.

C. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the minimum lot area requirement by 23.2 percent for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to reduce the minimum lot area requirement by 23.2 percent located at the property located at 1101 University Ave SE.

D. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the front yard requirement adjacent to University Avenue from the established setback of 27 feet to 15 feet to allow the building and a landing exceeding 36 square feet in area and to 0 feet to allow a plaza/walkway and stairs that exceed 6 feet in width and bicycle parking and to allow awnings to extend more than 2.5 feet into the required yard for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to reduce the front yard requirement adjacent to University Avenue from the established setback of 29.5 feet to 15 feet to allow the building and a landing exceeding 36 square feet in area and to 0 feet to allow a plaza/walkway and stairs that exceed 6 feet in width and to allow awnings to extend more than 2.5 feet into the required yard at the property of 1101 University Ave SE.

E. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the corner side yard requirement adjacent to 11th Avenue from 15 feet to 5.3 feet to allow the building and a landing exceeding 36 square feet in area and to allow awnings to extend more than 2.5 feet into the required yard for the property located at 1101 University Ave SE.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and deny the variance to reduce the corner side yard requirement adjacent to 11th Ave from 15 feet to 5.3 feet to allow the building and a landing exceeding 36 square feet in area and to allow awnings to extend more than 2.5 feet into the required yard at the property of 1101 University Ave SE.

F. Variance: Application by Jim LaValle with Doran Development LLC for a variance to reduce the rear yard requirement (adjacent to the north lot line) from 5 feet to 2 feet to allow a generator and transformer and pads for each for the property located at 1101 University Ave SE.

Recommended Motion: The variance application to reduce the rear yard requirement has been withdrawn.

G. Site Plan Review: Application by Jim LaValle with Doran Development LLC for a site plan review for a multiple-family dwelling with 95 units located at 1101 University Ave SE.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and deny the application for site plan review to allow a multiple-family dwelling with 95 units for the property located at 1101 University Ave SE.
