1. Expansion of Temple Israel Memorial Park (BZZ-5460, Ward: 8), 4153 3rd Ave S (Kimberly Holien).

Staff report

A. Conditional Use Permit: Application by Temple Israel of Minneapolis for a conditional use permit to expand the existing cemetery to allow burials on three additional lots within the fenced cemetery area at 4153 3rd Ave S. The subject lots include Lot 7, Block 5 and Lots 6 and 7 of Block 6, Portland Park Addition to Minneapolis. 

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit to allow the expansion of burial sites within an existing cemetery located at 4153 3rd Ave S, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. Burial plots shall not be permitted within the required yards set forth in Section 546.280 of the zoning code. 

2. Jardin Magico – Mis Niños (BZZ-5499, Ward: 12), 4705 Cedar Ave S and 4700 Longfellow Ave S (Tom Leighton).

A. Variance: Application by Cornell Moore for a variance of corner side yard setback from the required 8 feet to 6 feet for the properties located at 4705 Cedar Ave S and 4700 Longfellow Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the north side yard setback from 8 feet to 6 feet for the length of the proposed building addition at 4705 Cedar Ave S and 4700 Longfellow Ave S.

B. Site Plan Review: Application by Cornell Moore for a site plan review for the properties located at 4705 Cedar Ave S and 4700 Longfellow Ave S.

Recommended Motion: The Department of Community Planning and Economic Development– Planning Division recommends that the City Planning Commission approve the site plan review application for a child care center on the properties located at 4705 Cedar Ave S and 4700 Longfellow Ave S, subject to the following conditions:

  1. All site improvements shall be completed by March 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

  2. The final site, elevation, landscaping and lighting plans shall be subject to review and approval by Planning staff before building permits may be issued.

  3. Short-term parking spaces shall be designated on the site plan, and physically identified through signage in the parking lot, for the purpose of dropping off and picking up children.

  4. The dimensions of proposed parking spaces on the east side of the building shall be corrected so that they comply with the dimensional requirements in the zoning code.

  5. Where it is absent, a landscaped yard of 7 feet shall be supplied along Longfellow Avenue between the parking lot and the property line.

  6. Seven additional trees shall be planted around the perimeter of the parking lot per zoning code requirement.

  7. The materials of the proposed dumpster enclosure should be modified to meet zoning code requirements.

3. 640 E Lake St (BZZ-5486, Ward: 6), 640 E Lake St (Tom Leighton).

A. Conditional Use Permit: Application by Richard L Morris, with Edina Investment Group, for a conditional use permit for an automobile convenience facility for the properties located at 640 E Lake St.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit for an automobile convenience facility for the property located at 640 E Lake St, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. The applicant must comply with the specific development standards for automobile convenience facilities as set forth in chapter 546 of the Minneapolis Zoning Code.

  3. Any proposed lighting and signage must comply with Chapters 535 and 543 of the Minneapolis Zoning Code.

B. Variance: Application by Richard L Morris, with Edina Investment Group, for a variance of the minimum lot area from the required 12,000 square feet to approximately 9,490 square feet for the properties located at 640 E Lake St.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for variances from the required 12,000 square feet of lot area to approximately 9,490 square feet, and from the required 100 feet of lot width to approximately 80.5 feet for the property located at 640 East Lake St.

C. Site Plan Review: Application by Richard L Morris, with Edina Investment Group, for a site plan review for the properties located at 640 E Lake St.

Recommended Motion: The Department of Community Planning and Economic Development– Planning Division recommends that the City Planning Commission approve the site plan review application for the reestablishment of an automobile convenience facility with gas pumps at the property located at 640 E Lake St, subject to the following conditions:

  1. The final site, elevation, landscaping and lighting plans shall be subject to review and approval by Planning staff before building permits may be issued.

  2. The building entrance shall be clearly defined and emphasized through the use of architectural features such as roofs or other details that express the importance of the entrance.

  3. The building façade shall utilize windows that are vertical in proportion.

  4. For alternative compliance, the architectural character of the east and south faces of the building shall be enhanced, and the number and variety of plant materials shall be increased in the landscaping areas along Park Ave and Lake St.

  5. A total of six trees shall be planted in the landscaped areas adjacent to the public street, and new trees shall be a minimum caliper of 2.5 inches.

  6. The concrete blocks utilized in the dumpster enclosure shall not be plain-faced concrete blocks.

  7. The walkway between the public sidewalk and building shall be kept free of obstructions in a manner that allows four feet of clearance. The walkway shall be protected from encroachment of vehicles by wheel stops or similar barriers.

  8. Four bicycle parking spaces shall be provided.

  9. Onsite filtration of stormwater shall be provided by discontinuous curbing, and appropriate stormwater BMPs (Best Management Practices) where recommended by public works staff.

  10. Upon relocation of the Park Ave driveway and curb cut, the applicant shall restore the neighboring property to public works standards, including restoration of street curbing, new sidewalks and lawn.

  11. All site improvements shall be completed by March 26, 2013, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4. Spirit on Lake (BZZ-5490, Ward: 9), 1238 Lake St E and 2930 13th Ave S (Janelle Widmeier).

Conditional Use Permit: Application by Scott Nelson with DJR Architecture, Inc., on behalf of Everwood Development, for a conditional use permit to increase the maximum height of a building from 56 feet to 59 feet to allow taller parapet walls for the property located at 1238 Lake St E and 2930 13th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to increase the maximum height of a building from 56 feet to 57.5 feet to allow taller parapet walls for the property located at 1238 E Lake St and 2930 13th Ave S, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

B. Variance:  Application by Scott Nelson with DJR Architecture, Inc., on behalf of Everwood Development, for a variance to reduce the interior side yard adjacent to the alley from 11 feet to 0 feet to allow building walls with residential windows for the property located at 1238 Lake St E and 2930 13th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the interior side yard adjacent to the alley from 11 feet to 0 feet to allow building walls with residential windows for the property located at 1238 E Lake St and 2930 13th Ave S. 

C. Site Plan Review: Application by Scott Nelson with DJR Architecture, Inc., on behalf of Everwood Development, for a site plan review for the property located at 1238 Lake St E and 2930 13th Ave S.

Recommended Motion: The Community Planning and Economic Development Department – Planning Division recommends that the City Planning Commission adopt the findings and approve the application for site plan review to allow a new mixed use building with 46 dwelling units for the property located at 1238 E Lake St and 2930 13th Ave S, subject to the following conditions:

  1. Blank, uninterrupted walls that do not include windows, entries, recesses or projections, or other architectural elements, shall not exceed 25 feet in length as required by section 530.120 of the zoning code.

  2. First floor windows for the nonresidential uses shall have clear or lightly tinted glass with a visible light transmittance ratio of 0.6 or higher as required by section 530.120 of the zoning code.

  3. At least 30 percent of the north first floor wall facing the surface parking lot shall be windows as required by section 530.120 of the zoning code.

  4. Nonresidential windows facing the parking lot shall not be blocked by shelving, mechanical equipment or other similar fixtures to allow views into and out of the building as required by section 530.120(b)(2)(e) of the zoning code. Nonresidential windows facing Lake Street shall not be blocked by shelving, mechanical equipment or other similar fixtures to allow views into and out of the building between 2 and 10 feet above the finished first floor level in order to increase the security of adjacent outdoor spaces and maximize natural surveillance and visibility.

  5. At least three, deciduous canopy trees shall be planted between the parking lot and 13th Avenue as required by section 530.170 of the zoning code.

  6. Columnar landscaping or a green screen shall be provided on the west first floor wall adjacent to the alley where stucco would be used as an exterior material to prevent graffiti as required by section 530.260 of the zoning code.

  7. The applicant shall work with the Public Works Department or Hennepin County to reuse the decorative fence installed as part of the Lake Street reconstruction project before building permits are issued.

  8. The applicant is encouraged to provide short-term bicycle parking along Lake Street East.

  9. Refuse storage containers and mechanical equipment shall be screened as required by sections 535.70 and 535.80 of the zoning code. Screening materials and height shall be identified on the final plans.

  10. Community Planning and Economic Development Department – Planning Division staff review and approval of the final building elevations, floor site, landscape and lighting plans.

  11. Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by March 26, 2013, or the permit may be revoked for non-compliance.

5. Cedar Riverside Townhomes (BZZ-5480, Ward: 2), 620-624 20th Ave S and 1922 7th St S (Hilary Dvorak).

Staff report

A. Conditional Use Permit: Application by Bill Buelow, with GMHC, for a conditional use permit to amend an existing Planned Unit Development to allow a four-unit attached townhouse development for the properties located at 620-624 20th Ave S and 1922 7th St S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the conditional use permit application to amend an existing Planned Unit Development to allow a four-unit attached townhouse development located at 620-24 20th Ave S and 1922 7th St S subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within one year of approval.

  2. As required by section 527.120 of the zoning code, the development shall comply with the standards of the following amenities from Table 527-1, Amenities totaling a minimum of 5 points: outdoor open space.

B. Site Plan Review: Application by Bill Buelow, with GMHC, for a site plan review for the properties located at 620-624 20th Ave S and 1922 7th St S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the site plan review to allow a four-unit attached townhouse development and surface parking lot located at 620-24 20th Ave S and 1922 7th St S subject to the following conditions:

  1. Approval of the final site, landscaping, elevation and lighting plans by the Community Planning and Economic Development Department – Planning Division.

  2. All site improvements shall be completed by March 26, 2014, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

C. Plat: Application by Bill Buelow, with GMHC, for a preliminary plat for the properties located at 620-624 20th Ave S and 1922 7th St S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the preliminary plat application for the property located 620-24 20th Ave S subject to the following conditions:

  1. The Reciprocal Easement Agreement shall be recorded with Hennepin County.

6. Tires for Less (Vac-1597, Ward: 8) (Aly Pennucci).

Staff report

A. Vacation: Application by Tires for Less to vacate the western half of the “T” alley in the block bound by 3rd Ave S on the west, Clinton Ave on the east, Lake Street E on the north and 31st St E on the south. The portion of the alley proposed for vacation is adjacent to the properties located at 3009-11 3rd Ave S and 301 Lake Street E.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission and the City Council adopt the findings and deny the vacation.

7. Gay 90’s Storefront (BZZ-5376, Ward: 7), 400 Hennepin Ave (Aly Pennucci).

Staff report

A. Nonconforming Use Expansion: Application by Dan Kaufman, on behalf of PJH Properties LLC, for an expansion/alteration of a nonconforming use to replace the existing 160 square foot projecting sign with a 160 square foot projecting sign with LED lighting and add a 30 foot by 12 foot canopy with a 105 square foot sign and two (2) 28.3 square foot dynamic signs on the property located at 400 Hennepin Ave in the B4S2 Downtown Service District and the DP Downtown Parking Overlay District.

Recommended Motion: The Community Planning and Economic Development - Planning Division recommends that the City Planning Commission adopt the findings and approve the expansion of nonconforming use to replace the existing 160 square foot projecting sign with a 160 square foot projecting sign with LED lighting and deny the expansion of nonconforming use application to add a 30 foot by 12 foot canopy with a 105 square foot sign and two (2) 28.3 square foot dynamic signs and in lieu thereof approve an expansion of nonconforming use to allow a 30 foot by 12 foot canopy with signs on each plane on the property located at 400 Hennepin Ave in the B4S2 Downtown Service District and the DP Downtown Parking Overlay District, subject to the following conditions:

  1. The total sign area on the property shall not exceed 260 square feet.

  2. Signs shall not be attached to the roof of the building.

  3. No additional dynamic signs shall be installed. The existing dynamic projecting sign (with flashing lights) may be replaced.

  4. The canopy shall be installed above an existing or new public entryway.

  5. The façade shall be improved so that the siding materials on the main level along Hennepin Avenue and 4th Street North shall be painted uniformly and maintenance on the other exterior materials completed, the window behind the existing Bacardi wall sign shall be restored, the windows on the 2nd level shall be free of clutter visible from the street and the property owner shall work with staff to identify opportunities to reinstall first floor windows on the elevations fronting a public street.

  6. Approval of the final sign and elevation plans by the Department of Community Planning and Economic Development – Planning Division. No signs shall be installed without first obtaining a sign permit.
