Committee of the Whole Consent Agenda – January 12, 2012

1.   Appointments to the Board of Adjustment (Staff: Hilary Dvorak)

Consider the following for appointments to the Board of Adjustment for terms to expire December 31, 2014: Matt Perry, Matthew Ditzler and Pamela Meier.

Recommended Action: Approve the appointments to the Board of Adjustment.

2. Dunwoody Apartments Tax Increment Financing (TIF) Plan (Staff: Beth Elliott)

Review for Comprehensive Plan consistency a proposed TIF district to facilitate the redevelopment of the vacant, historic Abbott Hospital complex at 110 18th Street East in the Stevens’ Square neighborhood.

Recommended Action: Approve the staff report – the item is consistent with The Minneapolis Plan.

1. Morrison Fenske & Sund (MS-217, Ward: 11), 119 Pratt St and 112 W Minnehaha Pkwy (Becca Farrar).

Staff report

A. Minor Subdivision: Application by Morrison Fenske & Sund, on behalf of Paul Frenz and Kenneth Abdo, for a minor subdivision for the properties located at 119 Pratt St and 112 W Minnehaha Pkwy in order to adjust the existing rear lot line approximately 5 feet, 6 inches.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission approve the minor subdivision to allow a rear lot line adjustment of approximately 5 feet, 6 inches for the properties located at 119 Pratt St and 112 West Minnehaha Pkwy.

2. North Loop Green Subdivision (PL-258, Ward: 7), 333 Washington Ave N and 328 4th St N (Hilary Dvorak).

Staff report

A. Plat: Application by Bob Pfefferle with Hines Northstar Crossings Limited Partnership, for a preliminary and final plat for the properties located at 333 Washington Ave N and 328 4th St N. The purpose of the plat is to subdivide the existing parcels of land into multiple parcels for redevelopment purposes.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission adopt the findings and approve the preliminary and final plat application for the property located 333 Washington Ave N and 328 4th St N subject to the following conditions:

  1. The Reciprocal Easement Agreement shall be recorded with Hennepin County.

  2. The width of Traffic Street shall be shown as 40 feet as identified by Public Works.

  3. All development shall be approved as part of a Planned Unit Development or the land shall be replatted or otherwise arranged to meet the street frontage requirements of Chapter 598, Land Subdivision Regulations.

3. Linden Corner (BZZ-5420 and Vac-1596, Ward: 13), 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S (Hilary Dvorak). This item was continued from the January 9, 2012 meeting.

A. Conditional Use Permit: Application by Carol Lansing with Faegre & Benson, on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a conditional use permit for a multiple-family dwelling with 40 dwelling units located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission continue the conditional use permit application for a multiple-family dwelling with 40 dwelling units located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S to the February 6, 2012, City Planning Commission meeting.

B. Conditional Use Permit: Application by Carol Lansing with Faegre & Benson, on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a conditional use permit to increase the height of the building from 3 stories/42 feet to 5 stories/59 feet for property located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission continue the conditional use permit application to increase the height of the building from 3 stories/42 feet to 5 stories/59 feet located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S to the February 6, 2012, City Planning Commission meeting.

C. Variance: Application by Carol Lansing with Faegre & Benson, on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a variance of the LH Linden Hills Overlay District to allow the building to be located more than 8 feet from the front and/or corner side property lines adjacent to Upton Ave S and W 43rd St for property located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission continue the variance of the LH Linden Hills Overlay District to allow the building to be located more than 8 feet from the front and/or corner side property lines adjacent to Upton Avenue South and West 43rd Street located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S to the February 6, 2012, City Planning Commission meeting.

D. Variance: Application by Carol Lansing with Faegre & Benson, on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a variance to allow bicycle racks and a vehicle height limiter (an overhead bar with columns) in the required front yard setback along Upton Ave S for property located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S.

Recommended Motion: The Community Planning and Economic Development Department - Planning Division recommends that the City Planning Commission continue the site plan review application for the property located at 4242, 4246, 4246 ½, 4250 and 4264 Upton Ave S to the February 6, 2012, City Planning Commission meeting.

F. Vacation: Application by Carol Lansing with Faegre & Benson, on behalf of Mark Dwyer with Linden Hills Redevelopment, LLC, for a right-of-way vacation (Vac-1596) for a trapezoidal area adjacent to 4264 Upton Ave S.

Recommended Motion: The Department of Community Planning and Economic Development – Planning Division recommends that the City Planning Commission continue the application to vacate the trapezoidal area adjacent to 4264 Upton Ave S to the February 6, 2012, City Planning Commission meeting.

Amending Chapter 537 related to Zoning Code: Accessory Uses and Structures

Amending Chapter 541 related to Zoning Code: Off-Street Parking and Loading

Amending Chapter 543 related to Zoning Code: On-Premise signs

Amending Chapter 546 related to Zoning Code: Residence Districts

Amending Chapter 547 related to Zoning Code: Office Residence Districts

Amending Chapter 548 related to Zoning Code: Commercial Districts

The purpose of the amendment is to implement the policies of the Urban Agriculture Policy Plan. 

Recommended Motion: The Community Planning and Economic Development Planning Division recommends that the City Planning Commission and City Council adopt the findings and approve the zoning code text amendment, amending chapters 520, 530, 535, 536, 537, 541, 543, 546, 547, 548, 549, and 550. Staff further recommends that chapters 525, 527 and 551 be returned to author.
